Which brings us to the definition of posted land. I know many of us have come across fenced land in the woods with no signs anywhere. Some of us have come across unfenced land with and without posted signs. So what's the law? In Florida, land is considered properly posted when it meets one of the following criteria. (see F.S. 810.011)
1. If there are signs no less than 500 feet apart bearing 2 inch letters that say POSTED or NO TRESPASSING and bear the land owner's name at a height of 3 to 5 feet.
2. A land owner can also paint his posting and information on trees at the same intervals and height in orange paint .
3. The land can also be properly posted by simply being fenced with wire, wood or block at least 3 feet above the ground.
4. Land that does not require posting or fencing is any land less than 5 acres with a home on it, or agricultural land with active agricultural or horticultural practices taking place.
Cattle pastures, orange groves, strawberry fields and other crops are considered posted land by virtue of the fact that they are active farming areas. Further, trespassing with a weapon is considered a third degree felony. If convicted of a felony, you can kiss you gun ownership rights goodbye.
He's hunting land that was purchased for development then prolly repoed by the banks. I understand what kind of land cityslicker is hunting I think. There's a piece in Brooksville that is all woods and not posted but is for sale and is loaded with game,does that mean I can hunt it?
well this is the way i see it.. Ok i own 1000 acres of property just over grown land. So i dont put up barbwire fence or signs. Ok.. Now one day im on the land that I OWN and see someone walking through the woods Im going to approach them and possibly have my gun drawn. Especially if i see a visible gun on them. I will have mine drawn and pointed at their head as im talking. If the convo goes well gun will be put down and hopefully i can tell him not to come here any more. But if it goes sour then God will only know what would happen.
Thats just me trying to put myself in the place of the land owner who didnt put up fence or signs. Thats what i would do. And im sure most of the people from "up that way" would be the same or even worse.
well it would suck to shoot if the person dont have a gun. But like i was told the first time i purchased a gun in fl. The guy at the shop said "If you take a shot make it count, Its better to only have one side of the story" Go big or go home. And i kept those words and still keep them in my head everytime i thing i might need to draw my gun.
Better to shoot first than to have to return fire. Best defense is a good offense. I say make em holy like the pope, cept full of holes.
