This is a "loophole" I would never try to test. I am the type of man to fly under the radar, I don't want to draw attention to myself. When this passes, which it will, I will more than likely NEVER open carry. It s just the simple fact that we, as 2nd amendment activists need to win these little battles. If we lose the little ones, we will lose the war
Funny story, I have carried concealed for a long time. My wife's best friend never knew it, as I have told my wife to never discuss it with anyone. We were over at her house and I got off the couch after sitting for a long time, and my shirt was pulled up, and she saw the butt of my pistol. She was shocked that I was carrying, and I was like "Honey, every time you have ever seen me, I have been carrying...." She said she had no idea. I was like, yep I like it that way.
Here is another thought, and a serious question...
The biggest topic of this bill is that it is to protect concealed weapon carriers in case our weapon is accidentally seen (shirt lifts up reaching, jacket blows open, etc) by a member of public
Can anyone actually post a link to an incident in the state of FL, where a CWP holder was arrested and/or convicted for this offense? I am not talking about some schmuck carrying a gun, I am strictly referring to a CWP holder who accidentally brandishes his gun

About 12 years ago, I was in a Publix in Palm Springs, Florida shopping with my daughter who was then 8 years old. I had just bought a S&W Mountain Gun in .45 Colt, and a nice holster for it. I had a T shirt tucked in and a button down dress shirt over it. It's a big revolver, but the holster held it close and it wasn't noticible. Apparantly, while shopping I had bent down to pick something off a low shelf and the tail of the shirt got caught on the grip. I had no idea, until I was quietly approached from behind by two Palm Springs police officers, who were being very cautious, but discreet. They told me they needed to talk and didn't want to cause any undo attention. I told them I understood, and they walked behind me to the managers office, my daughter in my arms. They told me to keep my hands in plain sight, and asked why I was armed. I showed them my CCW and apoligized profusely for my error. They said I should be very careful, because the situation could have been much worse. I agreed, told them it would never happen again, thanked them for their professionalism and they left. I also appologized to the manager, and it turned out he had a CCW also, so he understood how it could happen. It was a careless thing to do, and I've been very aware of it since then.
For this year, we have failed to legalize common sense open carry provisions that would protect the right of Floridians to bear arms in whatever manner is appropriate to their environment and situation.
The Florida Senate accepted a last minute amendment by Sen. Bogdanoff (R) that removed the well considered open carry provision and replaced it with language that is subjective, vague, and only intended to address the NRA's sole OC "talking point" of momentary or inadvertent exposure of your licensed, concealed, handgun.
Florida Carry, Inc. was formed to protect all Americans who choose to exercise their fundamental right to bear arms for self defense while residents or visitors to the great state of Florida. We are quite encouraged by our recent political victories in multiple Florida counties and the pending success of HB 45 (Preemption Enforceability)
We are working on a "hail Mary" effort to salvage the current open carry bill.
We are also already drafting next year's pro-gun legislation and planning additional "grass roots" activities for our members.
Remember that it took 7 years for "Shall Issue" concealed carry to pass here. This is a fight that WE WILL WIN! For it be successful, we need you to Join Florida Carry and be ready to advocate loudly (but politely) for our rights.
Some one once said "Every little bit helps". I guess that is how we should feel about the signing of SB 234. I am grateful that Gov. Scott signed this bill on 6-17-'11 because it does protect me as a concealed carry licensee not to be in violation if my weapon is inadvertently displayed because the wind was blowing up my shirttail and was observed by one of the many "nut cases" that now inhabit our great state. There are some other provisions in this bill that are also beneficial. This bill and others that were signed this session , though not all we had hoped for, shows some common sense being displayed when it comes to our 2nd Amendment rights.
