Folks,
Some may have read that I am planning on a Primitive Archery Hog Hunt this coming weekend, and a friend asked me a question.
Say for instance I shot a hog at a close distance, say out to 20yards or less. and the wounded hog did not drop in it's tracks, as would be expected. Then saw us and began to charge me/us. I was unable to reload my bow with another arrow as the animal would be on top of us rapidly. Would we be justified by finishing off the hog with say a Boar Spear? FOr the most important reason to prevent bodily harm coming to us? How do you think this weapon would be classified by the FWC? large hunting knife?
And that same note, I do have a CCW permit, and could legaly carry a pistol, concealed, onto the WMA, if charged by the wounded animal before it died, could i use my firearm to protect my self? and shoot the charging animal?
I know this sounds like a very grey area, is there any case law or previous cases where something like this has happend, and the hunter was justified?
again I will pose this question the FWC to see what they have to say, but as of yet, I have not heard back from them on my first question I sent them.....
So I wont hold my breath for an answer.
Isnt the purpose of a CCW permit to be able to carry a gun on your person for protection? Sounds like you would be using to protect yourself. If you did shoot the big cause it charged you and its during General Gun then your good cause a pistol is legal then. If its during a season when hunting with pistols is not allowed then you better have evidence that the pig was attempting to attack you when you shot it. JMO
UNderstood, which is why I am concerned about the use of a spear? It could be said that I shot the hog with the arrow, and the spear was becauase when we located said piggy, it was not dead yet, and a spear was a better method of dispatching the animal humanly as possible? or it could be argued that it was the primary weapon, and the bow / arrow was used to dispatch the animal when found still alive?
So you see the question at hand is very "Grey" ish
That's a good question. Someone on here might have an idea. As for me it sounds like you would be ok but, I don't know :sheet .
